Terms of Service

1. Purpose

These Terms of Service (ToS) govern the use of the Kognify mobile application published by Domoveillance. By using the application, you accept these conditions in their entirety.

2. Service Description

Kognify is a brain game application offering:

• Engaging games to challenge your mind
• Personalized progress tracking
• Detailed statistics
• A leaderboard system

3. Account Registration

3.1 Account Creation

To access all features, you must create an account by providing:

• A valid email address
• A secure password

3.2 Account Responsibility

You are responsible for the confidentiality of your login credentials. Any activity performed from your account is presumed to be done by you.

3.3 Anonymous Mode

You can use the application without an account, but your data will not be saved and some features will be limited.

4. Acceptable Use

By using Kognify, you agree to:

• Provide accurate information during registration
• Not create multiple accounts
• Not attempt to bypass security systems
• Not use the application for illegal purposes
• Not cheat or manipulate scores
• Respect other users

5. Premium Subscription

5.1 Premium Benefits

Premium subscription gives access to:

• All games (60+ games total)
• Unlimited sessions
• 2× XP
• Advanced statistics
• Ad removal
• Access to Premium themes
• Zen mode
• Global leaderboards
• Advanced use of the Kogi coach

5.2 Pricing and Billing

• Price is displayed in the application before any purchase; for reference, €47.99 per year or €8.99 per month in France, VAT included, with the local price displayed at the time of purchase prevailing
• Billing is managed by Google Play (purchases on Android) or by Stripe (purchases on the web, card payment)
• Subscription renews automatically

5.3 Free Trial

An optional 7-day free trial may be offered if your account is eligible according to Google Play or Stripe. A payment method is required to start it, but no amount is charged during the trial. At the end of the trial, the subscription automatically renews at the displayed price unless you cancel before the trial ends. The trial can be canceled at any time.

5.4 Cancellation

You can cancel your subscription anytime from Google Play (purchases on Android) or from "Manage subscription" in your Kognify profile on the web, which opens the Stripe customer portal (purchases on the web). Premium access remains active until the end of the paid period.

5.5 Refunds

For a purchase on Android, refund requests are handled in accordance with Google Play policies; contact Google Play support. For a purchase on the web, contact us at [email protected]. Detailed terms are set out in the Sales Terms.

6. Gems

Gems are points that allow you to unlock cosmetic items (themes, avatars) or a temporary trial of a Premium game. Gems:

• Have no real monetary value
• Are not refundable
• Are not transferable between accounts
• Can be obtained for free (by watching ads) or purchased

7. Intellectual Property

The Kognify application, its content, design and features are the exclusive property of Domoveillance. You are not permitted to:

• Copy or reproduce the application
• Modify or create derivative works
• Distribute or sell the application
• Perform reverse engineering

8. Limitation of Liability

Domoveillance is not liable for:

• Indirect damages related to application use
• Data loss due to circumstances beyond our control
• Alleged cognitive results or benefits
• Temporary service interruptions

9. Service Availability

We strive to keep the application available 24/7. However, we reserve the right to:

• Temporarily suspend service for maintenance
• Modify or discontinue features
• Suspend accounts for ToS violations

10. Changes to Terms

We may modify these ToS at any time. Substantial changes will be notified to you via the application. By continuing to use the application after modification, you accept the new terms.

11. Termination

11.1 By User

You can delete your account anytime from the application settings.

11.2 By Domoveillance

We may suspend or delete your account for ToS violations without notice or compensation.

12. Governing Law

These ToS are governed by French law. In case of dispute, French courts will have jurisdiction. EU consumers retain rights under the Consumer Rights Directive (2011/83/EU). For other jurisdictions, local consumer protection laws apply.
